Buyer's Terms & Conditions

• The Buyer agrees to pursue the purchase of listed machines solely through EXFACTORYAuctions.com (EXFA), a division of EX-FACTORY INC.
• Buyer agrees to the specific machine's "Terms & Conditions” as documented on EXFA at the time of the sale regarding: Inspection, Payment Terms, Shipping, Rigging, Loading, Crating, etc.
• Buyer agrees to pay EXFA a 10% Buyer’s Premium for each purchase through EXFA for each successful high bid. Furthermore, in the event the Buyer elects to pay using a form of payment other than certified check or wire transfer, then Buyer shall be charged an additional 3% Alternative Payment Fee.
• At the close of auction, the Highest Bid above the reserve wins. If two or more Bids of equal value are placed, the first bidder of the equal value is the winner. The bidder is notified if the Bid placed is of equal or lesser value than current bids at when the bid is confirmed onscreen and via email.
• Buyer agrees that all transactions are subject to a $ 25 processing fee
• Buyer agrees to remit payment via credit card, company check, wire transfer or certified funds to EXFA by the close of the 2nd business day following the receipt of Invoice. NOTE: Customers paying via certified check or wire transfer will receive a 3% discount in their buyer's premium reducing it to 10%.
• Buyer has read EXFA's "Getting Started" information on the EXFACTORYAuctions.com website and clearly understands how the system works. For any questions, please call EXFA at 704-841-1921 x367 or send an email to auction@exfactory.com prior to placing a bid.
• All equipment is offered “as is, where is, and with all faults” with no guarantee or warranty.
• The Buyer agrees to a limit of liability for any transaction that shall never exceed the amount of the purchase price of the machine(s) in question.
• Buyer agrees to hold EXFA harmless for any non-successful bids or if placed bids do not exceed the Reserve Amount as determined by the Seller.
• EXFA reserves the right to disable any user's account who fails to comply with acceptable online auction behavior, as determined by EXFA.
• In the event the EXFA Web site is unavailable at any point during the auction process and for any reason, the Buyer agrees that EXFA is not responsible for any potential damages resulting from the unavailability of the Web site.
• The Buyer acknowledges and agrees that EXFA simply provides a marketplace by which Sellers can sell their machinery. EXFA tries to verify the accuracy of the specifications, descriptions, images and videos prior to placing the machinery on the auctions, however, EXFA is in no way responsible for any specification, description, image or video of machinery that is presented on the Web site.
• All information regarding or describing equipment for sale is provided by the current owner. EXFA does its best to ensure that the information received is published accurately, and does not accept responsibility regarding the accuracy of information or descriptions supplied.
• In the event of a legal dispute against EXFA, the laws of the State of North Carolina shall be in effect, and the venue for all proceedings will be Mecklenburg County in North Carolina.
• Buyer, unless a resident of North Carolina, is responsible for determining if the purchase is liable for sales tax in their state & remitting all applicable monies the proper authority.
• All equipment is offered as is, where is, and with all faults with no guarantee whatsoever.
• Unless otherwise agreed to in writing, all equipment is offered “as is, where is and with all faults” with no guarantee or warranty.
• All information regarding or describing equipment for sale is provided by the current owner. EXFA does its best to insure that information received is published accurately, and does not accept responsibility regarding the accuracy of information or descriptions supplied.
• Specifications are correct to the best of EXFA's knowledge, obtained from sources deemed reliable. Still, we encourage your inspection prior to the sale to confirm accuracy, as EXFA cannot guarantee them to be correct.
• The Buyer agrees to a Limit of Liability for any transaction that shall never exceed the amount of the purchase price of the machine(s) in question.
